These Terms of Service ("Terms") govern your access to and use of the DataSentry services, including our website, application programming interfaces (APIs), and any related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

API Usage

Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately. If you wish to terminate your account, you may simply discontinue using the Service.

All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Limitation of Liability

To the maximum extent permitted by law, in no event shall DataSentry, its affiliates, agents, directors, employees, suppliers, or licensors be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

In no event shall DataSentry's total liability to you for all claims under these Terms exceed the amount you paid DataSentry during the 12 months prior to the event giving rise to the claim.

Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, the Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Without limiting the foregoing, DataSentry makes no warranty that the Service will meet your requirements or be available on an uninterrupted, secure, or error-free basis.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Delaware, and you hereby consent to the personal jurisdiction and venue therein.
